Civil Requirements for Canadian Citizens

CHECKLIST

Valid Canadian passport;

Proof of Canadian citizenship  (Canadian birth certificate or Certificate of Canadian Citizenship). (If you were born in Québec: Only birth certificates issued on or after January 1, 1994, by "Le Directeur de l'état civil" in the province of Québec are accepted);

Document issued by the competent Vital Statistics authorities in Canada confirming that no registration of marriage appears in their records (if obtainable);

Complete details of the future spouse (full name, date and place of birth, residence, father's name and  mother's maiden name);

Final divorce decree or death certificate of previous spouse (if divorced or widowed);

Affidavit  : fill Form A if the affidavit is made at the Canadian Embassy in Rome, or the Consulate General in Milan. Fill form B if sworn in front of a Notary Public in Canada or a Consular Official at Canadian Embassies or Consulates in other countries.

1. Italian law requires NON ITALIANS wishing to be married in Italy to present a "Nulla Osta" (Certificate of non Impediment) or equivalent documentation.

2. The Canadian Government does not issue "Nulla Osta".  However, to assist Canadians to meet the Italian requirements, the Canadian Embassy in Rome or the General Consulate in Milan both prepare a declaration containing the relevant information.

3. To obtain the declaration from the Embassy or Consulate General, a Canadian citizen must first complete and swear an affidavit to the effect that there is no impediment to the proposed marriage.

4. If the affidavit is to be made at the Canadian Embassy in Rome, or the Consulate General in Milan the applicant must set up an appointment (we can do it for you), bring the above mentioned documents and fill out the appropriate form "A" (we can send you a copy). Our coordinator will accompany you.

If you wish Romeo and Juliet can help you in obtaining this declaration:

- You bring the above documents and swear the Affidavit in front of a notary public in Canada or a consular official at Canadian Embassies  or Consulates in other countries. In this case an affidavit form Form "B"  has to be filled out.

- Send  by email or by fax copies of your documents to Romeo and Juliet and to Canadian Embassy or Consulate in Italy.

- We check with the Embassy or consulate if everything  is OK and in the affirmative you can send the originals to the Embassy or Consulate and they will issue the Nulla Osta.

 

5. Once the declaration is issued (by the Embassy or Consulate General) it must be presented to the competent "Prefettura Ufficio Legalizzazioni" (provincial authority) to be formally authenticated. (we can do it for you). A revenue stamp of Euro 14,62 each declaration is required.

6. Once the declaration has been obtained and legalized, it is presented to the Marriage Office of the Municipality in Italy (we can do it for you)  Banns are waived  if neither party is Italian nor residing in Italy. 

7. The Municipal authorities may request the couple make a declaration few days before the civil wedding. This case you need to plan your arrival few days before your ceremony.  We will advise you with ample time should this be required.

Present fee is Euro 35 each for the affidavit and Euro 35 each for the declaration in lieu of Nulla Osta. You can pay it by cash or by international bank draft (in case you send documents by post).
