Civil Requirements for Canadian Citizens

Italian law requires NON ITALIANS wishing to be married in Italy to present a "Nulla Osta" (Certificate of non Impediment) or equivalent documentation.

The Canadian Government does not issue "Nulla Osta".  However, to assist Canadians to meet the Italian requirements, the Canadian Embassy in Rome prepares a declaration containing the relevant information.

To obtain the declaration from the Embassy in Rome, a Canadian citizen must first collect a specific set of documents and fill and swear an affidavit to the effect that there is no impediment to the proposed marriage.

You may swear the affidavit in front of a notary public in Canada or a consular officer at Canadian Embassies worldwide including the Canadian Embassy in Rome upon appointment.

CHECKLIST

To issue a "Nulla Osta" the Canadian Embassy in Rome requests the following list of documents:

- Valid Canadian passport;

- Proof of Canadian citizenship  (Canadian birth certificate or Certificate of Canadian Citizenship). (If you were born in Québec: Only birth certificates issued on or after January 1, 1994, by "Le Directeur de l'état civil" in the province of Québec are accepted);

- Document issued by the competent Vital Statistics authorities in Canada confirming that no registration of marriage appears in their records (if obtainable);

- Complete details of the future spouse (full name, date and place of birth, residence, father's name and  mother's maiden name);

- Final divorce decree or death certificate of previous spouse (if divorced or widowed);

- Affidavit; you must complete and swear an affidavit to the effect that there is no impediment to the proposed marriage. You may swear the affidavit in Canada, or at the Canadian Embassy in Rome upon appointment. Complete the Affidavit form but sign it ONLY when you swear in front of the Officer.

If you wish Romeo and Juliet can help you in obtaining this declaration:

1. You bring the above documents and swear the Affidavit in front of a notary public in Canada or a consular officer at Canadian Embassies  or Consulates in other countries.

2. Send  by email or by fax copies of your documents to Romeo and Juliet and to Canadian Embassy in Rome.

3. We check with the Embassy or consulate if everything  is OK and in the affirmative case you can send the originals to the Embassy in Rome and they will issue the "Nulla Osta".

4. Once the declaration is issued (by the Embassy) it must be presented to the competent "Prefettura Ufficio Legalizzazioni" (provincial authority) to be formally authenticated. (we can do it for you). A revenue stamp of Euro 14,62 each declaration is required.

5. Once the declaration has been obtained and legalized, it is presented to the Marriage Office of the Municipality in Italy (we can do it for you)  Banns are waived  if neither party is Italian nor residing in Italy. 

6. The Municipal authorities may request the couple make a declaration few days before the civil wedding. This case you need to plan your arrival few days before your ceremony.  We will advise you with ample time should this be required.

 

Present fee is Euro 29 each for the affidavit at the Canadian Embassy and Euro 29 each for the declaration in lieu of Nulla Osta. You can pay it by cash or by international bank draft (in case you send documents by post).
